Covered harm

Damage and compensation

Article 6 defines the damage categories covered by the new Directive. The right to compensation does not extend to every product-related loss, and other legal regimes may cover different losses.

Personal injury and property

Covered categories include death or personal injury, including medically recognised damage to psychological health. Property damage has exclusions, including the defective product itself, certain damage to the finished product by an integrated component and property used exclusively for professional purposes. Keep the damaged item and its use clear.

Data and resulting losses

Article 6 includes destruction or corruption of data not used for professional purposes. It covers material losses resulting from the specified damage and non-material losses to the extent compensable under national law. A data leak or pure disappointment is not automatically the same as destruction or corruption.

Different regimes may remain relevant

Article 6 does not displace national compensation rules under other liability regimes. A commercial loss excluded here may still require contract, negligence or another statutory analysis. Do not use the Directive's scope to assert that no remedy exists, or to estimate compensation without the relevant national basis.

Records that help the review

Use the following as a practical starting point. Select and preserve records appropriate to the product, incident and applicable procedure.

  • Nature and date of the harm
  • Property identity and actual use
  • Medical or restoration evidence where relevant
  • Loss calculation with applicable national basis

This site does not calculate compensation or assess whether an individual loss is recoverable.
